What is the Canada H-1B pathway?

Prime Minister Mark Carney announced the accelerated pathway in the 2025 federal budget. It creates a dedicated route for US H-1B visa holders to settle in Canada and builds directly on the 2023 H-1B Open Work Permit pilot, which filled its 10,000-application quota within hours.

The broader plan commits Canada to 380,000 PR admissions per year from 2026 to 2028, backed by a C$1.2 billion investment to recruit more than 1,000 top researchers. IRCC has confirmed the H-1B stream but said program details will arrive "in the coming months."

Who is eligible?

Based on the 2023 pilot design and budget language, eligibility is expected to center on skilled workers currently holding H-1B status in the US. The pathway targets four sectors:

  • Technology and software engineering
  • Engineering (civil, mechanical, electrical, biomedical)
  • Healthcare (physicians, nurses, allied health)
  • Scientific and academic research

Two implementation paths are likely: a new standalone PR stream operating outside Express Entry with a hard cap, or fast-track processing of existing Express Entry profiles from H-1B holders. Either way, no prior Canadian work experience is expected to be required.

Why Canada is targeting H-1B holders

The US raised H-1B fees to US$100,000 for overseas applicants in September 2025 and introduced a wage-based lottery for FY2027. Meanwhile green card backlogs for Indian nationals have barely moved: EB-2 India sits at July 2014 and EB-3 India at November 2013 - waits of 12 to 13 years.

Canada offers PR in roughly six months via Express Entry FSW, and the US work visa system is pushing skilled workers to look north. A parallel 40% cut in Canadian temporary resident admissions balances the PR expansion.

How to prepare now
