What Changed in the Wage-Based H-1B Lottery

For the first time, the H-1B lottery is no longer purely random. USCIS now prioritizes selections by Department of Labor wage levels: Level 4 registrations are selected first, then Level 3, Level 2, and Level 1.

Master's-cap applicants receive weighted chances based on wage level as well. A Level 4 master's-cap registration has a much higher selection probability than a Level 1 regular-cap registration. This fundamentally changes who gets picked - seniority and compensation now matter more than luck.

How to check your results

Only employers and attorneys can view results via the myUSCIS portal - beneficiaries cannot check directly. Statuses you will see:

• Selected - eligible to file a petition (this is not an approval)
• Submitted - not selected in round 1, may be selected in a later round
• Denied - not eligible to file
• Invalidated - registration cancelled (typically for duplicate entries)

Notifications rolled out March 27-31, 2026. If your employer has not communicated a status by now, ask them to check the portal.

Next steps if selected

1. File the Labor Condition Application (LCA) with DOL - required before I-129
2. File Form I-129 within the 90-day window (April 1 - June 30, 2026)
3. Consider premium processing ($2,965) for a 15-business-day decision
4. Prepare specialty occupation evidence: job duties, degree match, client letters for third-party placements
5. Earliest employment start date: October 1, 2026

Build the strongest record possible. Detailed job descriptions, organization charts, and evidence that the role requires at least a bachelor's degree in a specific specialty reduce RFE risk.

What if you were not selected

You are not out of options. Several paths exist, some faster than H-1B:

• O-1 Extraordinary Ability visa - no lottery, no cap, based on sustained acclaim
• L-1 Intracompany Transfer - for multinational employees with 1+ year abroad
• Cap-exempt H-1B - universities, nonprofits, government research organizations
• EB-1A or EB-2 NIW green card - self-petition, no employer sponsor needed
• Canada Express Entry - six-month PR, no lottery
• Germany Opportunity Card - points-based job-search visa, no job offer required
• UK Global Talent visa - fast-track for tech, science, arts, research

FY2027 by the numbers

With estimated 200,000-250,000 registrations chasing 85,000 spots, selection rates may land around 34-43%. The wage-based system also means the actual rate varies dramatically by wage level.

Impact of the $100K overseas fee

Overseas H-1B applicants processed at US consulates now pay US$100,000. This dramatically reduced overseas registrations and pushed many employers to reconsider filing even for selected candidates.

If drop-off rates run high, a Round 2 lottery becomes more likely. Watch USCIS announcements in July and August. For workers affected by the fee, the Canadian and US visa alternatives may now be more attractive than fighting the lottery again.
