I-797 Notice of Action - What It Is & Types Explained

Hızlı yanıt

Form I-797 is the official notice USCIS sends in response to any application or petition. Common variants are I-797C (receipt notice confirming USCIS got your filing), I-797A (approval with new I-94), I-797B (approval for consular notification), and I-797E (electronic notification or RFE). Each I-797 prints your receipt number, A-number, priority date, and the action taken.

What an I-797 is

Form I-797 is a single-page document mailed by USCIS in response to every filing they accept. It is your evidence that USCIS has your case in its system. You should keep every I-797 you ever receive - they prove timely filing for status purposes.

Types of I-797

  • I-797C, Notice of Action - receipt notice, biometrics appointment, transfer notice, RFE issuance, or rejection. The most common form.
  • I-797A - approval notice with attached I-94. Used for in-country status approvals (H-1B extension, change of status).
  • I-797B - approval notice for consular notification. Used when the beneficiary will get a visa abroad.
  • I-797E - Request for Evidence (RFE) or other electronic notification.

What information is on it

  • Receipt Number - 13-character tracking code.
  • Priority Date - when USCIS received your underlying petition.
  • A-number (USCIS#) - your permanent identification number.
  • Form filed - I-130, I-140, I-485, I-765, etc.
  • Notice Date - the date USCIS issued the I-797.
  • Validity - for approval notices with I-94, the start and end of your authorized stay.
  • Action Taken - what USCIS did (received, approved, transferred, RFE, etc.).

Sık sorulan sorular

Is the I-797 the same as a visa?

No. I-797 is a USCIS notice. The visa is the stamp in your passport, issued by a US embassy. An H-1B approval (I-797B) authorizes you to apply for the visa abroad.

Can I work using only my I-797?

An I-797A approval with new I-94 can serve as work authorization for the named employer until expiry. An I-797B is for consular processing - does not by itself authorize work.

How long should I keep my I-797 notices?

Forever. They prove timely filing, status validity, and case history - useful in future petitions, RFEs, and naturalization.

How do I get a copy of my I-797 if I lost it?

Online filings: download from myUSCIS. Paper filings: call the USCIS Contact Center (800-375-5283) to request a duplicate. Old cases: file FOIA via Form G-639.
