How to check your USCIS case status

The dreaded RFE - Request for Evidence
The Request for Evidence is the single most consequential status update in the USCIS system. It is not a denial, but it starts a hard clock that, if missed, becomes one.
The most common triggers:
- Missing documents - the most common reason, by a wide margin.
- Insufficient evidence to establish eligibility under the regulations.
- Inconsistencies between forms or between your filing and other USCIS records.
- Additional information needed for security clearance or background-check completion.
How to respond:
- The deadline is 87 days from the date of the RFE notice. This deadline is hard - extensions are essentially never granted.
- Respond to every item listed in the RFE. Partial responses are treated as non-responses.
- Attach a cover letter that references the RFE and indexes each item to the response.
- Send via tracked mail - USPS certified, FedEx, or UPS - to the address on the RFE notice.
- Keep complete copies of the response, including delivery confirmation.
Status hasn't changed in months - what to do
The same six-step escalation playbook applies whether the stuck case is an EAD, I-485, I-140, or N-400.
- Check official processing times on egov.uscis.gov/processingtimes.
- Submit a free e-Request on the USCIS website.
- Call the USCIS Contact Center at 1-800-375-5283 and request a Tier 2 officer.
- Request a Congressional inquiry through your US Representative or Senator's constituent services.
- File a USCIS Ombudsman complaint at dhs.gov/case-assistance.
- As a last resort, file a federal mandamus lawsuit. Attorney fees typically $3,000 to $8,000.

Common status patterns by form type
- I-485 typical pattern: Received → Biometrics Scheduled → Actively Reviewed → Interview Scheduled → Approved → Card Produced → Delivered.
- I-140 typical pattern: Received → Actively Reviewed → Approved (often quickly with Premium Processing).
- I-765 typical pattern: Received → Card Produced → Delivered. There is no interview for most EAD categories.

USCIS vs VFS tracking - what's different

The two systems are separate, with different statuses, different timelines, and different escalation paths.
