Frequently asked questions
Can my attorney attend my green card interview?
Yes. Unlike consular interviews, attorneys can attend I-485 adjustment of status interviews. We recommend bringing your attorney for complex or marriage-based cases.
Can my spouse and I be interviewed separately?
Yes - this is called a 'Stokes interview' and happens when the officer suspects marriage fraud. You'll be interviewed in separate rooms, then compared.
What happens if I fail my green card interview?
Officers usually don't deny on the spot. They may request more evidence (RFE) or schedule a second interview. Final denial leads to NTA (Notice to Appear) for removal proceedings in some cases.
How long is a green card interview?
Employment-based: 15-30 minutes. Family-sponsored: 20-40 minutes. Marriage-based: 30-90 minutes (or longer if Stokes).
Can I bring an interpreter to my green card interview?
Yes. You can bring a non-attorney interpreter or use the embassy's interpreter. The interpreter must speak English fluently and not be related to your case.
What documents should I bring to a green card interview?
Originals of: passport, I-94, all approval notices, I-485 receipt, EAD, AP, medical exam I-693, tax returns, employment letter, photos (marriage cases), criminal records (if any).
