The H-1B to green card journey
The 5-stage pipeline with current timelines: PERM (472 days) → I-140 (15 days premium) → Visa Bulletin Wait (13+ years EB-2 India) → I-485 (8-16 months) → Green Card. The complete guide covers every step, fee, and strategy: H-1B to green card guide 2026 →
Key 2026 changes
- OBBBA raised I-485 to $1,440 and I-140 to $815 (details)
- EAD auto-extension ENDED in October 2025
- Enhanced FBI background checks since April 2026
- $100K H-1B fee for overseas petitions
- 75-country freeze does NOT directly affect India, but distorts visa allocation (explainer)

Should you switch EB-2 to EB-3?
The question every Indian is asking after the June retrogression.
- EB-2 India: September 1, 2013
- EB-3 India: December 15, 2013
- Gap: EB-3 is 3.5 months AHEAD
Pros: EB-3 ahead now, more movement this month, same priority date transfers.
Cons: may be temporary, EB-3 has fewer annual visa numbers, could retrogress in July/August, downgrade costs USCIS fees and a new I-140 review.
Our take: wait for July/August data before switching. If EB-3 stays ahead by August, the case strengthens. Do not panic-switch on one month of data. See the full discussion in the June bulletin plain-English explainer.
Alternatives - skip the 13-year wait
EB-1A (Extraordinary Ability)
Self-petition, no PERM, 15 days premium. EB-1 India is at December 2022 - a ~3.5 year wait versus EB-2's 13+ years. Meet 3 of 10 criteria. If you have publications, patents, high salary, or awards, EB-1A saves you about 10 years.
EB-2 NIW (National Interest Waiver)
Self-petition, no PERM, no employer needed. Same EB-2 backlog (13+ years) but freedom to change jobs anytime - no employer dependence.
O-1 visa
No cap, no lottery, 15-day premium. O-1 is the best H-1B alternative. Most Indian tech professionals with 5+ years experience and some publications can qualify. Read H-1B alternatives 2026.
Canada - your insurance policy
Every time EB-2 India retrogresses, Google searches for "Canada Express Entry" spike from US IP addresses.
