Auto-extensions ended - what this means

Before October 30, 2025, USCIS allowed eligible renewal applicants to keep working under their expired EAD for up to 540 days while waiting for the new card. That bridge no longer exists.

Now: when your EAD expires, you must stop working immediately. If your renewal is still pending, you have no legal authorization. Resuming work without authorization is a serious immigration violation.

• Affected categories: nearly all renewal applicants except certain TPS cases
• The 180-day filing rule: USCIS recommends filing renewal exactly 180 days before expiration
• No bridge: you cannot work between expiration and new card receipt
• Premium processing: limited to certain (c)(9) AOS applicants for $1,780

New EAD validity periods

USCIS reduced new EAD validity to 18 months for many categories in late 2025 (previously 2 years for most AOS applicants). This means you must renew earlier and more frequently.

• AOS applicants (c)(9): 18 months (was 2 years)
• H-4 EAD (c)(26): linked to H-1B principal expiration
• F-1 OPT (c)(3)(B): 12 months
• F-1 STEM OPT (c)(3)(C): 24 months
• Asylum applicants (c)(8): 5 years (one of few that increased)

Eligibility for premium I-765 (as of 2026):

• Filed concurrently with I-485 in employment-based AOS
• Initial filing only - not most renewals
• Categories: (c)(9) for I-485 pending
• The 30-day clock starts only after USCIS receives complete supporting evidence

H-4 EAD crisis

H-4 spouses face the worst combination of long waits and no premium option. With H-1B holders increasingly relying on spouse income, the 6-9 month H-4 EAD wait creates a forced unemployment period at every renewal.

Strategies for H-4 EAD holders:

• File renewal immediately at the 180-day mark - do not delay
• Time international travel away from EAD expiration
• Build savings buffer for the 1-3 month likely unemployment gap
• Consider H-1B for the spouse if eligible (avoids H-4 dependence)
• Track the H-1B FY2027 lottery results for spouse alternatives

When to file your EAD renewal

1. 180 days before expiration: file I-765 renewal (this is the recommended date)
2. 150 days before: USCIS issues receipt notice
3. 120 days before: biometrics appointment if required
4. 90 days before: USCIS begins active review
5. Day 0 (expiration): old EAD expires, you must stop working unless renewal arrived
6. After expiration: gap period until new EAD arrives - no legal employment

What if your EAD expires before renewal arrives

• Stop working immediately on the expiration date
• Your employer must stop paying you until you have a valid EAD
• Do not work "under the table" - this jeopardizes future immigration benefits
• Request emergency expedite if you can document financial hardship
• Contact your Member of Congress for inquiry
• Consult an immigration attorney if the gap exceeds 30 days
• Some employers may grant unpaid leave during the gap
