The big picture - what happened in May 2026
After April 2026's extraordinary forward movement, the State Department has frozen virtually every employment-based category in May. April was historic: EB-2 India advanced 303 days in a single month, EB-3 Rest of World gained 244 days, EB-4 Special Immigrants jumped 365 days, and EB-2 ROW became Current. May reverses none of those gains, but it also delivers no new ones.
The deeper change is structural. USCIS switched from Chart B (Dates for Filing) to Chart A (Final Action Dates) for all employment-based adjustment-of-status filings - the first Chart A month in over six months. Chart B remains available for family-sponsored categories, but every EB applicant now files under the more restrictive Final Action Dates.
Only two categories moved at all: EB-3 Other Workers ROW and Mexico advanced 92 days, and EB-5 China Unreserved gained 21 days. Every other India and China date held flat. The May bulletin reads as the system absorbing April's surge of new I-485 filings.
The State Department warns that retrogression remains possible before September 30, 2026 if demand exceeds supply or if the 75-country immigrant visa freeze is amended. EB-5 India is the immediate flag - the bulletin includes explicit retrogression language.

Chart A vs Chart B - why this matters
Chart A (Final Action Dates) controls whether your I-485 can be APPROVED. Chart B (Dates for Filing) controls whether you can FILE I-485 at all. Chart B is always more favorable - the dates are further advanced because the system pulls applications forward to begin processing.
USCIS chooses each month which chart applies. April used Chart B; May switched to Chart A. The practical impact differs by category:
- EB-2 India: Filing was Jan 15, 2015 → Final Action Jul 15, 2014 = 6-month effective rollback
- EB-3 India: Filing was Jan 15, 2015 → Final Action Nov 15, 2013 = 14-month effective rollback
- EB-3 ROW: Filing was Current → Final Action Jun 1, 2024 = anyone with priority date after Jun 2024 can no longer file
- EB-2 China: Filing was Feb 1, 2022 → Final Action Sep 1, 2021 = 5-month rollback
Critical detail: if you filed I-485 in April under Chart B, your application remains valid and pending. You receive EAD and Advance Parole while waiting for approval under Chart A. Do not withdraw.
EB-2 India deep dive
EB-2 India is the most-searched green card category. Final Action Date holds at July 15, 2014 - unchanged since January 2026 when it advanced 14 days from July 1. April advanced this date 303 days under Chart B; May freezes everything as the system absorbs the surge of new filings.
The pending case backlog stretches more than 12 years. Filing date (Chart B) shows Jan 15, 2015, but it is unusable in May. EB-2 NIW (National Interest Waiver) follows the same dates. Strategy by priority date:
- Priority date Jul 2014 or earlier and in the US: file I-485 immediately - the date is current
- Priority date Aug 2014 - Jan 2015: you could file in April under Chart B but cannot file in May
- Priority date after Jan 2015: monitor monthly bulletins; consider EB-3 to EB-2 porting if you hold an advanced degree
EB-2 to EB-3 downgrade is rarely useful here - EB-3 India sits 8 months behind at Nov 15, 2013. The standard play is to file I-485 the moment your date is current to lock in EAD and Advance Parole, regardless of when final approval lands.
EB-3 India deep dive
EB-3 India sits at November 15, 2013 - frozen and 13+ years backlogged. Filing date (Chart B) shows Jan 15, 2015 but is unusable in May. The 14-month effective rollback from the Chart A switch is the largest of any India EB category.
The gap between EB-2 and EB-3 India is now 8 months (242 days). For applicants with priority dates between Nov 2013 and Jul 2014, EB-2 is the faster path. If you hold an advanced degree (Master's or Bachelor's plus 5 years progressive experience) and filed I-140 under EB-3, an EB-2 upgrade may save years.
EB-3 Other Workers ROW and Mexico advanced 92 days to June 1, 2024 - the only EB category outside EB-5 China to move at all in May.
EB-5 retrogression warning
EB-5 Unreserved India holds at May 1, 2022 - no movement. The State Department included explicit retrogression language in Section E of the May bulletin: "Sufficient demand and increased number use by India in the EB-5 unreserved visa categories may make it necessary to retrogress the final action date or make the category unavailable."
EB-5 China Unreserved gained 21 days, advancing from September 1 to September 22, 2016 - the only category outside EB-3 Other Workers to move. EB-5 set-asides remain Current for every country:
- Rural (20% reservation): Current
- High Unemployment (10%): Current
- Infrastructure (2%): Current
Action: if you are an EB-5 India investor with a priority date near May 2022, file IMMEDIATELY. The retrogression warning is rarely included as a standing notice - its presence in the bulletin signals heightened risk before September 30, 2026. New EB-5 investors should weigh set-aside categories: rural, high-unemployment, and infrastructure projects all remain Current with no India backlog.
75-country visa freeze - the hidden driver
April's historic advances and May's freeze both trace back to the same policy. The Trump administration imposed a nationality-based travel ban affecting roughly 40 countries and a separate immigrant visa processing pause covering 75 countries. The two policies overlap but are distinct.
The combined effect decreased consular immigrant visa issuances. Visa numbers that would have gone to those nationals were redistributed to applicants from non-affected countries - which is why April's bulletin showed historic gains for India, China, Philippines, Mexico, and ROW. May's freeze allows the system to absorb the surge of new I-485 filings before issuing more numbers.
The May bulletin carries the same warning: if demand increases or if administration actions are amended (i.e., the freeze lifts), retrogression may be necessary. What to do right now - action items by situation
If your EB priority date is current under Chart A:
- File I-485 immediately if in the United States
- File I-765 (EAD) and I-131 (Advance Parole) concurrently
- Get medical exam (I-693) - valid for 2 years and required for I-485 approval
- Benefits: work authorization, travel flexibility, protection against status gaps
If you filed in April under Chart B but are not current under Chart A:
- Your I-485 remains pending and valid
- You will receive EAD and Advance Parole on the standard processing timeline
- Final approval will come when your priority date becomes current under Final Action Dates
- Do NOT withdraw your application
If your date is not yet current:
- Prepare all documents now (birth certificates, police clearances from every country lived in 6+ months since age 18)
- Schedule medical exam when your date is within 6 months of becoming current
