The 472-day analyst review is by far the longest stage. PWD has actually improved from 2023-2024 (was 6-10 months, now 4-7). Combined with the recruitment window and cooling period, even a clean PERM case averages 12-15 months end-to-end.

Step 1: Prevailing Wage Determination (PWD)

Employer files Form ETA-9141 with DOL. DOL determines the minimum salary required for the position by SOC code and metropolitan area. Four wage levels apply: Level 1 (entry) through Level 4 (expert). Step 2: Recruitment

  • Job order with the State Workforce Agency (30 days minimum)
  • Two Sunday newspaper ads (for professional positions)
  • Three additional recruitment steps - job fairs, campus recruiting, employer website, professional journals, etc.
  • Internal posting at the worksite (10 business days)
  • Must demonstrate that no qualified US worker applied and was rejected for lawful reasons

Document every recruitment step. DOL audits routinely demand recruitment evidence.

Step 3: 30-day Cooling Period

After recruitment ends, the employer must wait 30 days before filing the ETA-9089. During this period, the employer reviews any applications received and documents lawful business reasons for rejecting US applicants.

Step 4: ETA-9089 filing

Electronic filing via the DOL PERM Online System. Priority date equals the filing date - this is the date that determines your place in the green card queue. See our priority date glossary entry. File PERM as early as possible to lock in an earlier priority date.

Step 5: DOL review

  • Analyst review: 472 days average (May 2026)
  • If no issues: case is CERTIFIED (approved). Proceed to I-140 filing.
  • If issues: case enters AUDIT. Employer responds within 30 days with documentation.
  • Major issues: SUPERVISED RECRUITMENT - DOL takes over recruitment process; case restarts under DOL oversight.

Approximately 30% of PERM cases are audited in 2026 (15-20% random selection, plus targeted audits based on case characteristics). Common audit triggers:

  • Job requirements that appear tailored to the foreign worker (unusual combinations of skills, languages, or experience)
  • Salary below market or at Level 1 for an obviously senior role
  • High number of PERM filings from the same employer in a short window
  • Recruitment documentation gaps
  • Small employer (under 10 employees) - heightened scrutiny
  • Position located in non-metro area
  • Random selection (~15-20% of all cases)

How to minimize audit risk:

  • Pay at or above Level 2 prevailing wage where reasonable - check the Salary Threshold Checker.
  • Keep job requirements aligned with industry-standard for the SOC code
  • Document ALL recruitment steps meticulously, with screenshots and dates
  • Use an experienced immigration attorney for case preparation
  • Avoid filing multiple PERMs for similar positions at the same employer in the same quarter

PERM refuse - et maintenant ?

If your PERM is denied, you face three options:

  • File a new PERM - but the original priority date is lost. You start over at today's date.
  • Motion to reconsider - available only for very narrow circumstances (clerical errors, new evidence).
  • BALCA appeal - Board of Alien Labor Certification Appeals. Slow but sometimes successful.

Common denial reasons:

  • Recruitment deficiencies - missed steps, missing documentation, improper ad placement
  • Wage issues - offered below prevailing wage, or wage level mismatch with role
  • Job requirement problems - tailored requirements, undefined preferences
  • Employer attestation errors - incomplete or inaccurate ETA-9089 form

A denial means starting over. Careful preparation and experienced legal counsel are the single most important factor in avoiding denial.

Comment PERM affecte votre H-1B

H-1B status is capped at 6 years total. PERM and I-140 are what allow you to extend beyond that cap via AC21.

  • With a PERM filed (and pending) for 365+ days OR an approved I-140: you qualify for 3-year H-1B extensions beyond the 6-year limit.
  • If PERM takes 472+ days and you wait until year 5 to file, you may run out of H-1B time before reaching I-140 approval.
  • If PERM is denied late, your H-1B clock keeps ticking - you may be forced to leave the US.

  • Employer must pay all PERM costs by law (20 CFR 656.12)
  • Employee CANNOT be charged for any part of PERM (attorney, recruitment, ads)
  • Typical employer cost: $5,000-15,000 (attorney + advertising + State Workforce Agency)
  • Employer must guarantee the job at the prevailing wage if/when the foreign worker becomes a permanent resident
  • If employer goes bankrupt during PERM: case dies
  • If employer is acquired: PERM may transfer to the successor (successor in interest)

PERM pour professions specifiques

Software engineers - most common PERM occupation. Level 2-3 wages most common; standard requirements; relatively low audit risk.
