Por qué ayuda una carta para visado de EE. UU. (aunque no sea obligatoria)
El Departamento de Estado de EE. UU. no exige una carta de presentación y técnicamente puede solicitar cualquier visado de no inmigrante sin ella. A pesar de eso, los abogados de inmigración la recomiendan para casi todos los solicitantes, en particular los que vuelven a solicitar tras una denegación 214(b), los procedentes de países de "alto riesgo" o quienes necesitan explicar su situación (cambio profesional, años en blanco, denegaciones previas).
Los oficiales consulares dedican dos o tres minutos por caso. Disponen de su DS-160, su pasaporte, una breve entrevista y (si la aporta) una carta de una página. La carta es su única oportunidad de responder a la pregunta tácita —¿regresará esta persona a casa?— antes de que comience la entrevista. El oficial suele leerla mientras usted se acerca a la ventanilla.
En virtud de la sección 214(b) de la Ley de Inmigración y Nacionalidad, se presume que todo solicitante de visado de no inmigrante es inmigrante en potencia. Travel.state.gov; su carta existe para superar esa presunción.

Cómo abordar 214(b): lo que los oficiales buscan realmente
Las denegaciones 214(b) se basan en una pregunta: "¿Tiene esta persona razones más fuertes para abandonar EE. UU. que para quedarse?". Los oficiales no asignan puntos formalmente, pero en la práctica lo siguiente pesa más:
- Empleo estable y permanente con carta de RR. HH. de permiso aprobado que especifica la fecha de regreso.
- Titularidad de propiedades en su país: escritura de la residencia principal o de una propiedad de inversión importante.
- Familia en su país, en particular cónyuge e hijos menores que se quedan.
- Titularidad de negocio: empresa registrada con contratos vigentes y declaraciones fiscales.
- Historial de viajes: visitas previas a EE. UU., Reino Unido, Schengen, Canadá, Australia o Japón con regreso. El cumplimiento es la señal más fuerte de cumplimiento futuro.
- Historial bancario que muestra una vida financiera estable a lo largo de 12+ meses, no solo un ingreso grande reciente.
Consistencia con el DS-160: cada detalle debe coincidir
La carta de presentación, el DS-160 y los documentos justificativos deben coincidir en cada detalle: ortografía del nombre, fecha de nacimiento, número de pasaporte, empleador, puesto, salario, dirección, fechas de viaje, vuelo de regreso. Un desajuste basta para una denegación 214(b) por "información inconsistente".
- Nombre: escriba su nombre en la carta exactamente como en el pasaporte; misma ortografía, mismo orden.
- Empleador: misma razón social que en el DS-160. "Tata Consultancy Services Limited" en el DS-160 no puede convertirse en "TCS" en la carta.
- Puesto: palabra por palabra idéntico al DS-160.
- Fechas de viaje: mismas fechas de llegada y salida en el DS-160, la carta y la reserva del vuelo.
- Dirección en EE. UU.: debe coincidir con la del apartado "contacto en EE. UU." del DS-160.
Qué NO decir en una carta para EE. UU.
- Nunca mencione intención de quedarse, trabajar, estudiar (fuera de su tipo de visado) o cambiar de estatus.
- Nunca diga "quiero vivir en EE. UU." o "me encanta el estilo de vida estadounidense". Eso señala intención inmigratoria y activa el 214(b).
- Nunca aporte motu proprio que tiene familiares ciudadanos o residentes permanentes; conteste con la verdad si se lo preguntan, pero no lo mencione sin que se lo pidan.
- Nunca describa el viaje como "abierto" o "flexible". Tenga siempre fechas exactas de llegada y salida con un vuelo de regreso reservado.
- Nunca suplique: nada de "por favor deme esta oportunidad" o "es mi sueño". A los oficiales no les mueve la emoción; les mueven las pruebas.
